Warranty Exclusions
This guarantee is void if the flashlight has been damaged by accident or unreasonable use, immersion in water at depth greater than the specified tolerance, neglect, battery leakage, subjecting to improper environmental conditions, improper service, or causes not arising out of defects in materials and workmanship. The warranty also does not cover any accessories including but not limited to lanyards, bulbs, and batteries.

All bulbs are manufactured with tolerance, especially the xenon-gas filled bulbs. Therefore, numerical measurements published in the catalog, website, or other marketing materials are only for references. PentagonLight™ does not guarantee lumen output, runtime, or the life of its bulbs.

All batteries including PentagonLight™ CR123A lithium batteries, the rechargeable batteries, and other batteries are shipped directly from our warehouse. Although every attempt will be made to ship only the freshest batteries possible, PentagonLight™ does not guarantee shelf-life and other performance characteristics of its batteries.

Limitation of Remedies
To the maximum extent permitted by applicable law, in no event will PentagonLight™ be liable for any special, incidental, or consequential damages to persons or property based on breach of warranty, breach of contract, negligence, strict liability, or any other legal theory. Damages that PentagonLight™ will not be responsible for include, but are not limited to, loss of profits; loss of savings or revenue; business interruption; loss of business information; wages and salaries; loss of use of the product or any associated equipment; cost of capital; cost of any substitute equipment, facilities, or services; downtime; the claims of third parties including customers; and injury to property even if PentagonLight™ has been advised of the possibility of such damages. Except as prohibited by applicable law, this limitation applies to claims for personal injury, loss of life, loss of consortium and wrongful death. Because some states and jurisdictions do not allow the exclusion or limitation of liability, the above limitation may not apply to the particular possessor of PentagonLight™ products.

Sole Warranty
Unless modified in a writing signed by both parties, this agreement is understood to be the complete and exclusive agreement between the parties, superseding all oral or written prior agreements and all other communications between the parties relating to the subject matter of this agreement, including statements made by salespersons. No employee of PentagonLight™ or any other party is authorized to make any warranty in addition to those made in this agreement. The buyer is warned, therefore, to check this agreement carefully to see that it correctly reflects those terms that are important to the buyer. If the buyer is only acting as a reseller of PentagonLight™ products, the execution of this warranty for the end user and not the buyer is at the sole discretion of Pentagon Scientific Corporation. If any portion of this warranty is found to be unenforceable, all remaining provisions shall remain in full force and in effect. If the product was acquired in the United States, this limited warranty is governed by the laws of the State of California. If the product was acquired outside the United States, then local law may apply.
